Right of Withdrawal for Consumers

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities.

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the date of contract conclusion.

To exercise your right of withdrawal, you must inform us (Nerdscave, Moritz Mantel Sole Proprietorship, Stockbrunnengasse 3, 97753 Karlstadt, Phone: (+49)09360 3589995, Email: kontakt@nerdscave.de) by means of a clear declaration (e.g., a letter sent by post or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form for this purpose, which is not obligatory. You may also electronically complete and submit the model withdrawal form or another clear declaration on our website (https://nerdscave-hosting.com/revocation/). If you make use of this option, we will immediately (e.g., by email) confirm receipt of such withdrawal.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse you all payments received from you, including delivery costs (with the exception of supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and no later than 14 days from the day on which we receive notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged fees for this repayment.

If you requested that the service should begin during the withdrawal period, you shall pay us a reasonable amount corresponding to the proportion of services already provided up to the time you notify us of your exercise of the right of withdrawal compared to the total scope of services envisaged in the contract.

Special Provisions for Server Rental Contracts

Pursuant to § 356 para. 4 no. 2 of the German Civil Code (BGB), your right of withdrawal for server services expires once the following cumulative conditions are met:

1. You have actively confirmed the checkbox “I expressly request that the service begins before the withdrawal period expires” during the ordering process
2. The consent was provided on a permanent data medium (e.g., through logging in the customer account)
3. You have confirmed your awareness that your right of withdrawal expires upon complete contract fulfillment
4. The server provisioning via mgmt.nerdscave-hosting.de has been technically completed (verifiable by timestamp)

Upon complete provisioning of the rented server, the service is deemed fulfilled. Withdrawal is excluded from this moment according to § 356 para. 4 sentence 2 BGB.

Your right of withdrawal irrevocably expires upon server provisioning, as this constitutes a fully performed service initiated before the withdrawal period expires in accordance with your explicit request (Art. 16(1)(a) of Directive 2011/83/EU). This applies regardless of whether you actually use the server.

Withdrawal is excluded after server provisioning, even if the 14-day withdrawal period has not formally expired. Any credit balance will only be refunded proportionally for unused contract periods following server deletion.
